These Terms of Service (“Terms”) constitute a binding legal agreement between you (“you,” “your,” or “Customer”) and Liquid Games (“we,” “us,” or “our”). These Terms govern your access to and use of our website, liquidgames.co (the “Site”), as well as your purchase of products or services through the Site (collectively, the “Service”).

By accessing the Site, creating an account, or making a purchase, you confirm that you have read, understood, and agree to be bound by these Terms, along with our Return Policy, Privacy Policy, and any other applicable policies referenced herein. If you do not agree to these Terms, you may not use the Site or Services.

1. Eligibility:

1.1 To use the Site or make purchases, you must be at least 18 years old. If you are between 13 and 18 years of age, you may only use the Site with the consent and supervision of a parent or legal guardian.

1.2 By accessing or using our Site, you confirm that you have the legal authority to enter into a binding agreement, and that all information you provide is true, accurate, and complete.

2. Prohibited Uses of the Site and Services:

You are not permitted to use the Site or Services for any of the following purposes:

  • Violating any applicable laws or regulations

  • Infringing upon the intellectual property rights of others

Any breach of these terms may lead to immediate account suspension, cancellation of orders, blocking of your IP address, and potential legal action.

3. Restricted Access & Denial of Service:

Liquid Games reserves the right, at its sole discretion, to restrict, suspend, or permanently terminate access to our website or purchasing capabilities for any customer account. This action may be taken for reasons including, but not limited to:

  • Engaging in abusive, fraudulent, or suspicious behavior

  • Initiating chargebacks or disputes that violate our policies

  • Attempting to bypass purchase limits or other restrictions

  • Conduct that is harmful to our business, staff, or community

Any orders placed by a restricted account—or efforts to bypass restrictions through the use of new accounts, false information, or third-party identities—will be canceled without prior notice. Liquid Games also reserves the right to take further action, which may include reporting fraudulent activity to payment processors, notifying law enforcement, or pursuing civil remedies as permitted by law.

4. Orders & Payment:

4.1 Liquid Games reserves the right to refuse, cancel, or limit any order at our sole discretion. This includes, but is not limited to, orders flagged for suspected fraud or unauthorized activity.

4.2 Full payment is required at the time of purchase. All transactions are processed securely through trusted third-party payment providers. We do not store complete payment information on our servers.

4.3 If you request to cancel an order, it will be subject to our Return Policy, including any applicable cancellation or restocking fees.

5. Pricing & Availability:

5.1 All prices are subject to change at any time without prior notice.

5.2 Product availability is not guaranteed and may be affected by distributor allocations or other supply factors. If an item becomes unavailable after your order is placed, we reserve the right to cancel the order and issue a full refund.

6. Pre-Order Policy:

By placing a pre-order, you agree to the following terms:

  • Payment is collected in full at the time of purchase.

  • Shipping will occur only after the official release date; early shipping is not permitted.

  • Pre-orders are non-refundable. Cancellation requests are subject to a 15% fee and may lead to account restrictions.

  • If your order includes both pre-order and in-stock items, it will ship once all items are available.

  • Release dates are subject to change due to delays from manufacturers or distributors.

  • Accounts that violate this policy may be suspended from placing future pre-orders.

    7. Product Condition & Packaging:

    7.1 We sell only manufacturer-sealed products. Please note that we are not responsible for:

    • Minor cosmetic imperfections to packaging (e.g., scuffs, dents, or corner wear)

    • Printing inconsistencies or minor defects present in factory-sealed items

    • Any issues that do not affect the condition or integrity of the product inside

    7.2 Product packaging is intended to protect the contents. We do not offer replacements for packaging that experiences normal wear and tear during shipping.

    8. Returns & Cancellations:

    All returns, cancellations, and refund requests are subject to the terms outlined in our Return Policy. By completing a purchase, you acknowledge and agree to comply with those terms.

    9. Intellectual Property:

    All content on the Site—including but not limited to images, product descriptions, logos, and trademarks—is the property of Liquid Games or its licensors. This content may not be copied, reproduced, distributed, or used in any form without prior written permission.

    10. Disclaimers & Limitation of Liability:

    10.1 All products are sold on an “AS IS” and “AS AVAILABLE” basis, without any warranties except those required by applicable law.

    10.2 To the fullest extent permitted by law, Liquid Games shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Site or purchase of products.

    10.3 Our total liability for any claim related to an order shall not exceed the amount you paid for that order.

    11. Dispute Resolution & Governing Law:

    11.1 These Terms are governed by the laws of the State of New Jersey, without regard to its conflict-of-law principles.

    11.2 Any disputes shall be resolved exclusively in the state or federal courts located in Ocean County, New Jersey, unless the dispute is subject to binding arbitration as described below.

    11.3 For disputes related to purchases, both parties agree to resolve claims through binding arbitration under the Commercial Arbitration Rules of the American Arbitration Association (AAA). Class actions and class arbitrations are not permitted.

    12. Indemnification:

    You agree to indemnify, defend, and hold harmless Liquid Games, its affiliates, officers, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses arising out of or related to your violation of these Terms or any applicable laws.

    13. Changes to Terms:

    We may revise these Terms periodically. The “Effective Date” at the top of this page shows the date of the latest update. By continuing to use our Site after changes are made, you agree to be bound by the revised Terms.
